Please use the Service after agreeing to these Terms. Article 1 (Definitions) In these Terms, the following terms shall have the meanings set forth below: (1) Service Services operated by the Circle and related services. (2) Content Collective term for text, sound, still images, videos, software programs, code, etc., provided on the Service (including posted information). (3) User Any person who uses the Service. (4) Service Platform Platform on which the Service is provided. (5) Personal Information Collective term for information that can identify individuals, such as address, name, occupation, and telephone number. (6) Registration Information Collective term for information registered by registered users on the Service (excluding posted information). (7) Intellectual Property Inventions, designs, new plant varieties, designs, copyrighted works, and other creative activities of humans (including natural laws or phenomena discovered or elucidated that have industrial applicability), trademarks, trade names, and other marks used to display goods or services in business, as well as trade secrets and other technological or business information useful for business activities. (8) Intellectual Property Rights Rights defined by law or legally protected interests related to patents, utility model rights, breeder's rights, design rights, copyrights, trademark rights, and other intellectual property. Article 2 (Agreement to these Terms) Users may use the Service after agreeing to these Terms. Upon authentication of the Service on the Service Platform and commencement of use, a usage contract under these Terms shall be established between the user and the Circle. If a user does not meet the minimum age criteria set by the Service Platform, please obtain consent from a parent or other legal representative before using the Service. If a user who does not meet the minimum age criteria set by the Service Platform uses the Service without the consent of a legal representative or by falsely claiming consent or age, or by using deceit to make others believe they have legal capacity, any legal acts related to the Service cannot be revoked. If a user who did not meet the minimum age criteria at the time of agreeing to these Terms later uses the Service after reaching the applicable age, such user shall be deemed to have ratified all legal acts related to the Service. Article 3 (Amendment of Terms) The Circle may revise the contents of these Terms at any time without obtaining the consent of users, and users shall accept such revisions without objection. When revising these Terms, the Circle shall notify users of the content by the method prescribed by the Circle. The revised Terms shall take effect from the time the Circle notifies users as per the preceding paragraph. Users shall be deemed to have agreed without objection to the revised Terms by using the Service after the revision of these Terms. Article 4 (Management of Accounts) Users shall voluntarily register and manage the information (hereinafter referred to as "Registration Information," including email addresses, IDs, passwords, etc.) necessary for use at their own responsibility. Users shall not allow third parties to use, lend, transfer, change the name, sell, or otherwise dispose of such information. If the Service is used based on Registration Information, the Circle may consider it as being used by the person who registered for use, and all responsibilities arising from such use shall belong to the person who registered. If damage is caused to the Circle or a third party due to the unauthorized use of Registration Information, users shall compensate the Circle and the third party for such damage. The Circle shall not be responsible for any disadvantages or damages incurred by users due to inaccurate or false Registration Information. If it is discovered that Registration Information has been stolen or used by a third party, users must immediately notify the Circle and follow the instructions provided by the Circle. Article 5 (Handling of Personal Information, etc.) Personal information and user information shall be handled appropriately in accordance with the "Papery Match Privacy Policy" separately stipulated by the Circle. Article 6 (Prohibited Acts) In using the Service, users are prohibited from the following acts. If users violate these prohibitions as determined by the Circle, the Circle may take measures such as temporary suspension of use or termination of membership for users. (1) Acts that infringe upon the intellectual property rights of the Circle or third parties. (2) Acts that defame or unfairly discriminate against the honor or reputation of the Circle or third parties. (3) Acts that infringe upon or may infringe upon the property of the Circle or third parties. (4) Acts that cause economic damage to the Circle or third parties. (5) Threatening acts against the Circle or third parties. (6) Acts of using computer viruses or harmful programs, or inducing such behaviors. (7) Acts that excessively burden the infrastructure facilities for the Service. (8) Attacks on the servers, systems, or security of the Circle's website. (9) Attempts to access the Circle's Service through methods other than those provided by the Circle. (10) Acquiring multiple user IDs by a single user. (11) Any other acts deemed inappropriate by the Circle. Article 7 (Disclaimer) The Circle shall not be liable for any damages arising from changes, interruptions, or termination of the Service. The Circle does not involve itself in or assume any responsibility for the user's environment for using the Service. The Circle does not guarantee that the Service meets specific purposes of users, possesses expected functions, product values, accuracy, usefulness, complies with applicable laws, regulations, or internal rules of industry associations applicable to users' use of the Service, or that no malfunctions will occur. The Circle does not guarantee that the Service is compatible with all information terminals. Users acknowledge in advance that there may be malfunctions in the operation of the Service due to upgrades of OS of information terminals used for the Service, and the Circle does not guarantee that such malfunctions will be resolved by modifications to the programs made by the Circle. Users acknowledge in advance that the use of all or part of the Service may be restricted due to changes in the Service Platform's terms of use and operational policies. The Circle shall not be liable for any damages, whether direct or indirect, incurred by users as a result of using the Service. The Circle shall not be liable for any damages, including loss of opportunity, interruption of business, or any other damages (including indirect damages and loss of profits), incurred by users or third parties, even if the Circle was informed in advance of the possibility of such damages. The provisions of paragraphs 1 to the preceding paragraph shall not apply in cases where the Circle is guilty of willful misconduct or gross negligence or when the contract is a consumer contract under the Consumer Contract Act. Even if the preceding paragraph applies, the Circle shall not be liable to compensate for damages caused by acts of negligence (excluding gross negligence), particularly damages arising from special circumstances. If the Circle is liable for damages due to the use of the Service, the liability for damages shall be limited to the amount of usage fees received from the user in the month when the damages occurred. The Circle shall not be responsible for any disputes or troubles between users and other users. In the event that users cause damage to other users in relation to the use of the Service or have disputes with third parties, users shall resolve such damages or disputes at their own expense and responsibility, and shall not make any claims against the Circle. If the Circle is claimed for damages or otherwise by third parties due to the actions of users, users shall resolve such claims (including legal fees) at their own expense and responsibility. If the Circle pays damages to such third parties, users shall pay all costs (including legal fees and loss of profits) to the Circle. If users cause damage to the Circle in relation to the use of the Service, users shall compensate the Circle for damages (including litigation costs and legal fees) at their own expense and responsibility. Article 8 (Paid Content) Users may purchase paid content by paying a fee for part of the Service. The amount of paid content, payment methods, and other matters shall be separately determined and displayed on the Service by the Circle. The Circle may change the price of content, whether free or paid, at its discretion. If a user delays payment for paid content, the user shall pay the Circle late damages at an annual rate of 14.6%. Paid content does not guarantee its value, usefulness, or completeness, and except as required by law, no refunds shall be made. The method and conditions for refunds in cases required by law shall be posted separately by the Circle. Paid content is permitted for use only with the user's own Registration Information. Article 9 (Termination of Service) The Circle may terminate the Service by notifying users through appropriate means. Users shall agree in advance without objection that if the Service is terminated, they will lose all rights to use paid content, and thereafter, they will not be able to use such paid content. The Circle shall not be liable for any damages caused to users or third parties due to the termination of the Service, regardless of the cause. Article 10 (Publication of Advertisements) Users shall be deemed to understand and agree that there may be advertisements of all kinds on the Service and that the Circle or its partners may publish any advertisements. The form and scope of advertisements on the Service may be changed by the Circle from time to time. Article 11 (Prohibition of Assignment of Rights) Users shall not transfer, in whole or in part, their status under these Terms or any rights or obligations based on these Terms to a third party without prior written consent from the Circle. The Circle may transfer all or part of the Service to a third party at the Circle's discretion, and in such cases, all rights of users related to the Service, including user accounts, shall be transferred to the transferee. Article 12 (Separability) Even if any provision of these Terms or any part thereof is judged to be invalid or unenforceable under the Consumer Contract Act or other laws, the remaining provisions of these Terms and the remaining parts of the provisions judged to be invalid or unenforceable shall remain in full force and effect. Article 13 (Contacting the Circle) Users' inquiries and contact with the Circle regarding the Service shall be made through a contact form installed at appropriate places on the Service or by a method separately designated by the Circle. Article 14 (Governing Law, Jurisdiction) The validity, interpretation, and performance of these Terms shall be governed by Japanese law and shall be interpreted in accordance with Japanese law. For any disputes, litigation, or other disputes between the Circle and users, etc., the Tokyo Summary Court or the Tokyo District Court shall have exclusive jurisdiction depending on the amount in dispute.
